Kansas Strengthens Water and Milk Regulations

During the recent legislative recess, Kansas Governor Laura Kelly signed a series of bills that carry significant implications for the state's agricultural sector, particularly for members of the Kansas Livestock Association (KLA). These new laws, enacted just before the Kansas Legislature reconvenes on April 10 for the veto session, aim to enhance the operational standards and financial security within key agricultural domains.

One of the pivotal bills signed into law is HB 2254, a measure specifically requested by the KLA. This bill mandates that milk processors hold payments in trust for milk producers until full payment is made.

To benefit from these protections, milk producers must issue a written notification of nonpayment within 30 days after the due payment date. This legislation aims to provide greater financial stability and security to milk producers by ensuring that their payments are safeguarded.

Additionally, water management within the agricultural sector received attention with the signing of HB 2085. This law applies exclusively to state permits for confined feeding facilities that house fewer than 1,000 head of livestock. 

It extends the duration of a state water pollution control permit from five years to ten years, doubling the permit's validity period and potentially reducing administrative burdens for small-scale livestock operators.

Another significant legislative development is the modification of the multi-year flex account statute through SB 58. This bill moves away from relying on historical water usage to determine base allocations for irrigation water rights. Instead, it calculates the base allocation using 110% of the net irrigation requirement multiplied by the authorized acres, which may allow for more tailored and efficient water use in irrigation practices.

As the veto session approaches, KLA staff will continue to engage with Governor Kelly to secure signatures on additional bills supported by the association. They will also monitor legislative developments closely.
