New law tightens rules on foreign agricultural land deals

In a significant move to bolster national security and protect the U.S. agricultural industry, Congress has passed the Consolidated Appropriations Act of 2024, which President recently signed into law.

This comprehensive spending bill, essential for funding the government, carries a crucial provision aimed at enhancing the review process of foreign investments in the agricultural sector.

A notable change is the inclusion of the U.S. Secretary of Agriculture in the Committee on Foreign Investment in the United States (CFIUS).

This committee, chaired by the U.S. Secretary of the Treasury, plays a crucial role in assessing foreign transactions for potential national security risks.

The addition of the agriculture secretary underscores the growing concern over foreign acquisitions of U.S. agricultural lands and industries.

Originally established in 1975 by President Gerald Ford, CFIUS is composed of several key cabinet members and is tasked with scrutinizing foreign investments. If a transaction poses a security threat, the President has the authority to block such deals, a testament to the mechanism's strength in protecting national interests.

This legislative enhancement was driven by increasing worries over agricultural land purchases by entities from adversarial countries.

The push for stricter controls garnered support from agricultural associations like NCBA and KLA, backing legislative proposals aimed at incorporating agricultural lands into CFIUS's review scope.

These efforts reflect a collective resolve to ensure that foreign investments do not compromise the United States' agricultural integrity or national security.

With these new provisions, the U.S. strengthens its defense against potentially harmful foreign investments, ensuring the agricultural sector remains a cornerstone of national security and economic prosperity.
